General Advice For Employers

Employers often view the rights and obligations arising through an employment relationship as a minefield which is best avoided. All too often, the consequences of this misconception are discovered too late which is unhelpful to both employer and employee and can prove expensive, for example, if an employee (or perhaps more usually, a former employee) takes proceedings in an employment tribunal.

Employers are therefore advised to ensure that they have in place proper documentation. In this way, both employers and employees are aware of their rights and obligations, which facilitates a harmonious and productive working relationship.

Even when issues do arise which need to be addressed, there is a clear framework for both the employer and the employee to follow. There will be times when hard decisions have to be taken but, with the appropriate principles stated, even the termination of employment can be safely achieved and the employer still be protected against the misuse of confidential information, intellectual property or unfair competition by former employees.
